What Is Assault in Texas?
According to Texas Penal Code Section 22.01, a person commits an assault if they intentionally, knowingly, or recklessly cause bodily injury to another person or intentionally or knowingly threaten another person with imminent bodily injury.
It is important to note that Texas law recognizes two types of assault: simple assault and aggravated assault.
- Simple Assault: Simple assault is a Class A misdemeanor, which is punishable by up to one year in jail and/or a maximum fine of $4,000. However, simple assault against certain protected individuals, such as peace officers, security guards, public servants, and family members, is a third-degree felony, which is punishable by 2 to 10 years in prison and/or a maximum fine of $10,000. Additionally, simple assault is a second-degree felony if the alleged victim was a concealed handgun license holder and the assault occurred as the defendant was entering or exiting a vehicle in which the license holder was located. A second-degree felony is punishable by 2 to 20 years in prison and/or a maximum fine of $10,000.
- Aggravated Assault: Aggravated assault is a more serious criminal charge that involves the use of a deadly weapon. A person commits an aggravated assault if they intentionally or knowingly cause serious bodily injury to another person or use or exhibit a deadly weapon during the commission of an assault. Aggravated assault is a second-degree felony, which is punishable by 2 to 20 years in prison and/or a maximum fine of $10,000. However, it is a first-degree felony if the alleged victim was a family member, public servant, security guard, or other protected individual, and the assault involved the threat of serious bodily injury or the use of a deadly weapon. A first-degree felony is punishable by 5 to 99 years or life in prison and/or a maximum fine of $10,000.
